Article 2 — Purpose

These terms and conditions govern the purchase of products and services through www.vinaeden.com. By placing an order, the customer accepts these terms in full.

Article 3 — Products & Pricing

• All prices include IVA (22%) as required by law
• Prices are in US dollars (USD) for the Uruguay store
• Viña Edén reserves the right to modify prices without prior notice
• Product availability is subject to stock. In case of unavailability after purchase, the customer will be notified and refunded
• Product images are representative; minor variations may occur between batches or harvests

Article 4 — Purchase Process

• The customer selects products, adds them to the cart, and proceeds to checkout
• An order confirmation email is sent after successful payment
• The purchase contract is formalized upon payment confirmation
• Viña Edén may cancel orders in case of pricing errors, fraud suspicion, or stock issues

Article 5 — Payment Methods

• Accepted methods: Visa, Mastercard, MercadoPago, and other methods displayed at checkout
• All transactions are processed through secure payment gateways with SSL encryption
• Viña Edén does not store credit card data

Article 6 — Shipping

• Shipping available throughout Uruguay
• Estimated delivery: 2-4 business days for Montevideo metropolitan area; up to 7 business days for other regions
• Shipping costs are calculated at checkout based on destination and order weight
• Viña Edén is not responsible for delays caused by force majeure or carrier issues
• The customer must verify the package condition upon receipt and report any damage within 24 hours

Article 7 — Right of Withdrawal

In compliance with Article 16 of Law 17.250 (Consumer Protection), for purchases made through this website:

• The customer has the right to withdraw from the purchase within 5 business days from the date of delivery, without need for justification
• To exercise this right, the customer must notify Viña Edén through a verifiable means (email to info@vinaeden.com or WhatsApp)
• The product must be returned unused, unopened, and in its original packaging
• Opened products (uncorked bottles) are excluded from this right per Art. 16-BIS literal C (health/hygiene protection)
• Return shipping costs are borne by the customer
• The refund of the product price will be processed promptly upon receipt and verification of the returned product
• This right does not apply to personalized or custom products (Art. 16-BIS literal A)

Article 8 — Warranty

• Products carry a 6-month legal warranty against manufacturing defects, as established by Law 17.250
• This warranty does not cover damage caused by improper storage, transport by the customer, or natural evolution of the wine
• In case of a defective product, the customer may request repair, replacement, or refund

Article 9 — Age Restriction

• Sale of alcoholic beverages is prohibited to persons under 18 years of age (Law 19.855)
• By placing an order, the customer declares they are 18 years or older
• Viña Edén reserves the right to request identification upon delivery

Article 10 — Experiences & Bookings

• Bookings for experiences are subject to availability
• Cancellation policies vary by experience type and are displayed during the booking process
• Viña Edén reserves the right to cancel or reschedule experiences due to weather or operational reasons, offering full refund or rescheduling

Article 11 — Intellectual Property

• All content on vinaeden.com (text, images, logos, designs, videos) is property of Viña Edén or its licensors
• Reproduction, distribution, or modification without written authorization is prohibited

Article 12 — Limitation of Liability

• Viña Edén is not liable for damages arising from improper use of products
• Website availability is provided "as is" without guarantee of uninterrupted access
• Viña Edén is not responsible for the content or practices of linked third-party websites

Article 13 — Amendments

• Viña Edén may modify these terms at any time
• Changes take effect upon publication on the website
• Continued use of the site after changes constitutes acceptance

Article 14 — Governing Law & Jurisdiction

• These terms are governed by the laws of the Oriental Republic of Uruguay
• Any dispute shall be submitted to the competent courts of the department of Maldonado, Uruguay
• The consumer may also file complaints with the Dirección General de Comercio — Área Defensa del Consumidor
